DRIVER NON-COMPETE AND NON-SOLICITATION AGREEMENT
This Agreement is made between ARS PRO LOGISTICS LLC ("Company"), a driver placement services company, and the undersigned driver ("Driver").
1. Placement. Company has introduced and placed Driver with one or more client carriers or businesses ("Assigned Company").
2. Non-Compete / Non-Circumvention. For twelve (12) months after Driver's last placement through Company, Driver agrees not to accept direct employment or contract work with any Assigned Company, or any company introduced to Driver by Company, without going through Company, unless Company gives written consent.
3. Non-Solicitation. During placement and for twelve (12) months after, Driver will not solicit or encourage other drivers placed by Company, or Company's clients, to bypass Company.
4. Confidentiality. Driver will keep confidential Company's client lists, rates, routes and business information.
5. Remedies. If Driver breaches this Agreement, Company may seek any remedy available by law, including injunctive relief.
6. Severability. If any part of this Agreement is found unenforceable, the remaining parts stay in effect, and the unenforceable part will be limited to the extent allowed by law.
7. Electronic Signature. By typing their full name below, Driver agrees this electronic signature is legally binding, the same as a handwritten signature.
